The Court issued a stay which has the effect of blocking enforcement of the OSHA rule nationwide while it is litigated in the lower courts. The opinion states that OSHA does not have the power to issue a mandate that is so wide-reaching without clear permission from Congress. This applies to the OSHA rule for private employers with 100+ employees and to the rule requiring state OSHA departments to adopt similar rules for public employees.
All other mandates remain in place and unaffected by this ruling. Federal and local governments can still mandate vaccines for its employees and contractors. Private employers, owners, and public employers can also still elect to have a vaccine requirement for their employees.
